NOTICE OF PROPOSED RULEMAKING

The Children, Youth and Families Department (CYFD) will hold a public hearing on December 3, 2026, from 10 a.m. to noon at the PERA Building located at 1120 Paseo de Peralta, Santa Fe, NM 87505, regarding proposed amendments to 8.10.2 NMAC - Protective Service Intake and 8.10.3 NMAC - Protective Service Investigation. The meeting will additionally be broadcast live via TEAMS, log-in details for the TEAMS meeting will be available on CYFD’s website beginning Monday November 2, 2026.

The Purpose of the Rule Hearing is to receive public input on the purposed amendments to both 8.10.2 NMAC and 8.10.3 NMAC. The proposed amendments provide direction to CYFD Intake Workers on screening abuse and neglect allegations related to substance-exposed infants exposed, as well as direction to CYFD Investigation Workers on how to proceed with assessing safety and making a decision on removal from home.

Interested persons may testify at the hearing or submit written comments no later than 5 p.m. December 3. Written comments will be given the same consideration as verbal comments given at the hearing. Written comments should be emailed to: cyfd.policy@cyfd.nm.gov.
