PROPOSED RULEMAKING

NOTICE IS HEREBY GIVEN that the Office of Superintendent of Insurance (OSI or Superintendent) will hold a public hearing in person, via video conference, and via telephone conference regarding a new proposed rule 13.21.6 NMAC, Medical Malpractice Claims. The hearing in this rulemaking will commence on Tuesday, July 28, 2026, at 10:00 a.m., MDT.
PURPOSE OF THE
PROPOSED RULE:
The purpose of this rulemaking is: 1) to establish administrative procedures
used by the Office of Superintendent of Insurance for processing claims for
payment from the Patient’s Compensation Fund; and 2) to receive public comment
on content of the associated form entitled Statutory Contribution
Acknowledgment.
STATUTORY
AUTHORITY: State Rules Act, Sections 14-4-1 et seq.,
NMSA 1978, Sections 59A-2-8 and 59A-2-9 NMSA 1978, the Administrative
Procedures Act, Sections 12-8-1 et seq., NMSA 1978, and the Medical
Malpractice Act, Sections 41-1-1 et seq., NMSA 1978.
